TUCSON BUYER FAQ

What Is an SPDS in Arizona Real Estate?

The Seller’s Property Disclosure Statement helps a buyer understand facts the seller knows about the property. It supports due diligence, but it does not replace independent inspections or verification.

THE SHORT ANSWER

SPDS stands for Seller’s Property Disclosure Statement. Most Arizona resale sellers provide one to answer questions about ownership, systems, repairs, environmental conditions, utilities, and other matters affecting the property.

Buyer guidance

What should a buyer review on the SPDS?

Read every answer and explanation, note blanks or inconsistencies, and compare the disclosure with the listing, inspection findings, permits, insurance information, and your own observations.

Buyer guidance

Does the seller or agent verify everything?

The seller answers from the seller’s knowledge. The real estate broker generally does not independently verify every response, so buyers should investigate information that matters to them.

Buyer guidance

What if the seller learns something new?

Disclosure duties can continue during the transaction. New material information should be addressed promptly and evaluated against the contract and applicable deadlines.

Buyer guidance

Does an SPDS replace a home inspection?

No. A disclosure reports what the seller knows; an inspection and other investigations help uncover conditions the seller may not know about.

RELATED QUESTIONS

A few more answers before you go.

Is every seller required to complete the same form?

The contract, property type, and seller circumstances matter. Even when a particular form is not provided, known material facts may still require disclosure.

When should the buyer receive it?

Follow the delivery deadline in the signed purchase contract.

Can a buyer cancel after reviewing it?

Any cancellation right and deadline come from the contract and applicable law.

What if an answer is incomplete?

Ask for clarification and independently investigate the issue before the relevant deadline.
